What Should My Estate Plan Include?
- Last Will and Testament (Will) – This document establishes how you would like your Estate administered after you die. You can designate, including but not limited to, whom you like to receive certain assets, you can designate the Executor of your estate, guardianship for minor kids, care for pets, etc. If you fail to create a Will the State will settle these decisions for you; and/or
- Trust – This document establishes how you would like your property distributed after you die. A Grantor or Settlor (You) will transfer property to the Trustee. The trustee will hold the property for your benefit or the benefit of an individual or entity you designate during your lifetime, and disperse these assets to whom you choose upon your death. A trust created during your lifetime is considered a Living Trust. A trust created by your will after you die is considered a Testamentary Trust; and
- Power of Attorney – This document allows the Estate Plan holder to designate an individual they trust to handle personal and financial affairs should you become temporarily or permanently incapacitated; and
- Health Care Directive – This document allows for the Estate Plan possessor to name someone to serve as an agent to coordinate medical care should you become temporarily or permanently incapacitated.
