Do I Need a Will?
People often contemplate whether they need a Will or not. From my experience as an Estate Planning attorney, it is absolutely necessary that anyone that owns personal property should have a valid will. When an individual dies with a Will it is defined by the Court as dying testate. When a person dies testate the Court will use the Will as specific instructions on how the deceased property shall be distributed. However, if an individual dies without a Will, intestate, the court does not have specific instructions from the deceased regarding their preference on how their property shall be distributed upon death. This would require the Court to use Georgia Probate Law to decide how your estate is distributed. Here’s a question, do you believe the Court can distribute your property to your loved ones better than you can? The answer is No!
That is why everybody needs a will.
What Can I Put in My Will?
By executing a valid Will, you can make gifts to loved ones of any item(s) of your choice such as Homes, Cars, Boats, Artwork, Jewelry, Guns, Stock, or any of your valued possessions. There are some exceptions to this rule of gifting through your Will: you cannot transfer illegal items, or make gifts against public policy.
In addition to gifting assets through your Will, you will also have the privilege to arrange guardianship for minor children and pets, donate to charity, designate the executor of your estate, make burial instructions, etc.
