What is a Trust?
A Trust is a legal document that allows a Grantor or Settlor (Creator of Trust) to legally gift their lifetime assets to whom they choose after death.
A Trust works by (1) a Grantor or Settlor funds the trust with assets deposited into the Trust and managed by Trustee(s). (2) Designation of a Trustee to manage the property governed by the rules of the Trust. (3) Designation of Beneficiaries that will receive benefit from the assets deposited into a Trust.
Trusts can be Revocable or Irrevocable in nature.
- A Revocable Trust is the most popular type of Trust which allows the Grantor or Settlor to solely make alterations to the Trust such as add provisions, remove provisions, or even cancel the Trust when the Grantor or Settlor sees fit. A Revocable Trust allows the creator of the Trust to serve as Trustee and manage the Trust.
- An Irrevocable Trust is a Trust agreement that in essence is written in stone. The Trust provisions cannot be changed, nor can the Trust be canceled solely by the Grantor or Settlor. In order to change or revoke provisions of the Trust, the Grantor or Settlor, Trustee, and all Beneficiaries must agree in writing to cancel or change the Trust.
